{"id":45417,"date":"2019-05-23T08:47:44","date_gmt":"2019-05-23T08:47:44","guid":{"rendered":"https:\/\/www.complete-ltd.com\/?p=45417"},"modified":"2023-01-20T04:09:54","modified_gmt":"2023-01-20T04:09:54","slug":"right-to-rent-checks-the-governments-guidance-for-letting-agents-after-brexit","status":"publish","type":"post","link":"https:\/\/www.complete-ltd.com\/zh-hans\/right-to-rent-checks-the-governments-guidance-for-letting-agents-after-brexit\/","title":{"rendered":"Right to rent checks: The Government\u2019s guidance for letting agents after Brexit"},"content":{"rendered":"\n<p>The Government has issued <a href=\"https:\/\/www.gov.uk\/guidance\/right-to-rent-checks-for-eu-eea-and-swiss-citizens-after-brexit\">new\nguidance<\/a> for letting agents and landlords who have been questioning how\nright to rent checks will be impacted by the United Kingdom leaving the\nEuropean Union. The Government has now clarified that there will be no changes\nto the current law until 1st January 2021.<\/p>\n\n\n\n<p>Under the current law in England, letting agents and\nlandlords must check that all prospective tenants aged 18 and over can legally\nrent a residential property before starting a new tenancy.<\/p>\n\n\n\n<p>Citizens from the EU, EEA and Switzerland can currently\nprove their right to rent by showing their passport or national identity card\nto their letting agent or landlord. This government has said that this will\nstay the same whether or not the UK leaves the EU with a deal.&nbsp; The guidance says that there will be no\nchange to the way citizens from the EU, EEA and Switzerland prove their right\nto rent until 1st January 2021.<\/p>\n\n\n\n<p>Irish citizens will continue to have the right to rent in\nthe UK and be able to prove their right to rent as they do now, for example\nusing their passport.<\/p>\n\n\n\n<p>Letting agents and landlords won\u2019t need to check whether new\nEEA and Swiss tenants arrived before or after the UK left the EU, according to\nthe guidance, or if they have status under the EU Settlement Scheme or European\ntemporary leave to remain.<\/p>\n\n\n\n<p>There also won\u2019t be any need to retrospectively check the\nstatus of EU, EEA or Swiss tenants or their family members who entered into a\ntenancy agreement before 1st January 2021.<\/p>\n\n\n\n<p>Letting agents and landlords should \u201ccontinue to conduct\nright to rent checks on all prospective tenants to comply with the code of\npractice on illegal immigrants and private rented accommodation and the code of\npractice for landlords: avoiding unlawful discrimination,\u201d according to the\nguidance.<\/p>\n\n\n\n<p>The Government has plans to introduce a new, single\nimmigration system from 1st January 2021 and new guidance on how to carry out\nright to rent checks from this date \u201cwill be issued in due course.\u201d<\/p>\n\n\n\n<p>Visit <a href=\"https:\/\/www.gov.uk\/guidance\/right-to-rent-checks-for-eu-eea-and-swiss-citizens-after-brexit\">gov.uk<\/a> for more information on right to rent checks.
